1. Who we are

These terms are between you and ScanMarkUK ("we", "us", "the seller"). By creating an account or continuing to use the ScanMarkUK service, you agree to these terms. If you use the service on behalf of a school or organisation, you confirm you have authority to bind that organisation; otherwise you confirm you are of legal age to enter into this agreement.

2. The service

ScanMarkUK is an automated marking tool for UK teachers. It analyses photographs of pupil work that you upload and generates whole-class feedback, re-teach starter activities and individual pupil feedback slips, aligned to the subject, key stage and lesson objectives you provide. Automatically generated feedback is a starting point for your professional judgement and may contain errors; you remain responsible for the feedback given to pupils.

We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have purchased. We do not guarantee that the service will be uninterrupted or error-free.

3. Acceptable use

You must not misuse the service. In particular, you must not:

  • use the service for any unlawful purpose, or to defraud, spam or harass others;
  • upload content that infringes anyone's intellectual property rights, or that you have no right to share;
  • interfere with the security of the service, including introducing malware, probing or scanning our systems, or scraping the service;
  • reverse engineer, resell, redistribute or circumvent the technical limits of the service;
  • upload images of pupils or their work without the consent or lawful basis required by your school's policies and applicable law.

4. Your account and content

You must keep your account credentials confidential and are responsible for all activity under your account. You must provide accurate information and keep it up to date. You retain ownership of the work you upload; you grant us a limited licence to host and process it solely to provide the service to you.

5. Intellectual property

We retain all ownership of the service and its intellectual property, including the software, documentation and branding. Nothing in these terms transfers any of our IP to you.

6. Payments, billing and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically until cancelled. Unused monthly subscription pages do not roll over; one-off Pay-As-You-Go page credits and free trial pages remain available while your account is active. Please also see our Refund Policy.

7. Suspension and termination

We may suspend or terminate your access if you materially breach these terms, fail to pay, pose a security or fraud risk, or repeatedly or seriously violate our policies. When your access ends, your saved scans may be deleted after a reasonable period; you may ask us for an export before then.

8. Liability

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability to you is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where the law does not allow it.

9. General

You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not responsible for delays caused by events beyond our reasonable control. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
